TIPS TO PROTECT YOUR WATER RIGHTS:
Before signing a gas lease contract ask yourself the following: In the gas drilling contracts, are you giving the gas companies the water rights? If you are, can the gas companies drill water wells on the property to get the millions of gallons of water needed to drill? Will these wells affect or dry up our aquifers? Can the gas companies get the water from wetlands or farm ponds? Can they pull the water from our rivers?
Always have an attorney, experienced in gas leases and real estate law, review the lease before signing. Make sure you are protected in the event of contamination by any source related to the operation, either by accidental spills or methane seeping through the shale as a result of land disturbance.
Finally, we have already been told that the gas drillers are already setting up in Otsego County. It appears that with the influx of the new state and federal legislators who are in favor of drilling the “anti-drillers”have essentially lost the battle.
